County Court Claims

We provide one level of service as follows:

1 - Receipt of instruction before 12.00 noon - Issue proceedings the same day

2 - Further 14 days following service of Court proceedings - to enter judgment

3 - Enforcement following judgment:

  1. County Court Bailiff for all claims or High Court Sheriff for claims greater than £1,000
The Sheriff is the preferred method of enforcement and more effective because he is on a commission based on recoveries. In successful cases the Sheriff's charges are recovered from the Debtor
  2. Charging Order
If the Debtor owns a property let us know or if you wish we can find out. If the Debtor owns a property we may be able to obtain a charge (mortgage) secured on that property in your favour
  3. Garnishee
Does anyone else owe your Debtor money? If so we can obtain an Order to ensure that you are paid by the Debtor's Debtor.
  4. Attachment of Earnings?
If your Debtor is in employment we may be able to obtain payment direct from his employer.
  5. Oral Examination
Your Debtor can be examined on Oath at Court to provide details of assets and income. This is an information gathering process and can in some cases result in payment or in obtaining information enabling a proper choice of enforcement being made.
